Terms of Service

Welcome to PhotoPod (“we”, “our”, or “us”). By accessing or using the PhotoPod mobile application or related services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the app.

1. Account Registration

• You must create an account to use PhotoPod and provide accurate information.
• Accounts may be created using email/password or third-party authentication providers such as Google or Apple.
• You are responsible for maintaining the security of your account and your device, and for all activity that occurs under your account.

2. User Content

• You retain ownership of the photos, captions, comments, and other content you submit (“User Content”).
• By submitting User Content, you grant PhotoPod a non-exclusive, worldwide, royalty-free license to host, store, display, and share your content within the app solely for the purpose of operating and providing PhotoPod’s services.
• You are solely responsible for your User Content and must ensure it does not violate any laws, third-party rights, or these Terms.

3. Automated Content Moderation

To help maintain a safe environment, photos uploaded to PhotoPod are automatically analyzed using third-party image moderation technology (such as Google Cloud Vision API). This analysis helps identify prohibited content, including nudity, sexual content, violent imagery, or other harmful material.

By uploading photos, you consent to this automated analysis. Content that violates these Terms or our moderation policies may be rejected, restricted, or removed.

4. Acceptable Use

• Do not post illegal, harmful, or offensive content.
• Do not harass, threaten, impersonate, or abuse other users.
• Do not attempt to disrupt, hack, reverse-engineer, or interfere with the app.
• Do not misuse invite links or attempt to gain unauthorized access to Pods.

5. Intellectual Property

• All rights, title, and interest in the PhotoPod app, including its design, branding, and code, are owned by PhotoPod.
• You may not copy, modify, distribute, or create derivative works from PhotoPod without our prior written permission.

6. Account Termination

• You may delete your account at any time through the app.
• Upon account deletion, your profile information will be removed. Content you shared in Pods may remain visible to other users but will be anonymized.
• PhotoPod may suspend or terminate accounts that violate these Terms or misuse the app.

7. Third-Party Services

PhotoPod relies on third-party services, including Firebase (Google LLC), for authentication, data storage, hosting, analytics, and content moderation. Use of these services is subject to their respective terms and policies.

8. Disclaimer of Warranties

PhotoPod is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, availability, or accuracy of the app.

9. Limitation of Liability

To the fullest extent permitted by law, PhotoPod shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the app, including loss of content, data, or access.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted with an updated effective date. Continued use of PhotoPod after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
